These Terms of Service ("Terms") govern your use of TaleToaster, a personalized children's audiobook service operated by Amit Bhawnani, a sole proprietor ("we", "us", "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account. By creating an account, you represent that:
- You are a parent, legal guardian, or otherwise have legal authority to consent to these Terms on behalf of any child whose profile you create
- You have the legal authority to share information about that child with us as described in our Privacy Policy
The intended end-listeners of generated content are children ages 2 through 10. Children do not directly use the account; the parent or guardian operates the app on their behalf.
2. Description of the service
TaleToaster is a mobile application that generates short personalized audiobooks (typically 4–5 minutes each) for children. Each story is generated using artificial-intelligence systems and is unique to the inputs you provide. You may save stories to a personal playlist within the app, and you may share individual stories via a public link generated by tapping the share button.
TaleToaster is published in the Apple App Store under the Kids Category. It contains no third-party advertising, no behavioral profiling, no analytics SDKs targeting children, and no in-app purchases that bypass parental gating.
We may modify, suspend, or discontinue any part of the service at any time. We will give reasonable notice of material changes that affect your ability to use the service.
3. Account responsibility
You are responsible for:
- The accuracy of the information you provide, including child profile information
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us promptly of any unauthorized use of your account
4. Acceptable use
When using TaleToaster you agree NOT to:
- Use the service for any unlawful purpose
- Attempt to generate content that is sexual, violent, defamatory, hateful, or otherwise harmful, especially as directed at any individual
- Submit "Anything else?" instructions that contain personal information about identifiable third parties without their consent
- Reverse-engineer, decompile, or attempt to extract our prompts, models, or proprietary configurations
- Scrape, harvest, or extract data from our service in bulk
- Resell, sublicense, or redistribute the service or any portion of it
- Use the service in any way that interferes with its operation or with other users
We may suspend or terminate accounts that violate these rules.
5. Generated content
Stories generated for your child are yours to keep, share with family, and play in any private setting.
You may not:
- Use generated stories for commercial purposes
- Republish them on a public platform that would compete with TaleToaster
- Misrepresent generated stories as having been created without AI assistance, in contexts where that distinction would matter to a reasonable person (e.g., a school assignment that requires original work)
We retain ownership of the underlying TaleToaster service, the application code, the brand, the theme catalog, the cover artwork, the curated "Did you know?" trivia bank, and the prompts that drive the generators.
6. AI-generated content disclosure
Stories on TaleToaster are generated by large-language-model AI systems. While we work to ensure stories are age-appropriate, free of harmful content, and pleasant to listen to, we cannot guarantee that every story will meet your expectations or be free of imperfections. You acknowledge:
- Story content is generated programmatically and may occasionally include unexpected language, plot twists, or factual inaccuracies
- We do not endorse any specific moral, religious, or political viewpoint that may appear in a generated story
- It is your responsibility, as the parent or guardian, to preview content if you have specific sensitivities
- The "Did you know?" trivia card shown during story generation displays human-curated facts. We make a good-faith effort to ensure these are accurate and age-appropriate, but mistakes are possible. If you spot one, please report it via the in-app feedback form.
If you encounter content that violates our community guidelines, please report it via the in-app feedback form so we can improve our generation prompts.
7. Pricing and payments
TaleToaster is currently free during the beta period. Once we exit beta, paid plans may be introduced. Any paid plans will be clearly disclosed in the app before charging, and stories you generated during the beta will not be retroactively charged.
If you purchase a subscription through the App Store, payment is charged to your Apple ID and managed through your Apple ID account settings. Subscription renewals, upgrades, and cancellations are handled through the App Store.
8. Public sharing
When you tap "Share" on a story, you authorize the creation of a public link that anyone with the link can use to play that single story on this website. By sharing the link you grant any recipient permission to play the story. You can stop a share link from working by deleting the underlying story in the app, or by deleting your account.
9. Account deletion
You may delete your account at any time, immediately, from inside the app:
- Open Settings → Danger Zone → Delete Account.
- Read the warning, tap Continue.
- Solve a simple math question (e.g., "27 + 38 = ?"). This step prevents accidental deletion.
On confirmation, your account, all child profiles, all saved stories, all audio files, all share links, all in-app feedback, and all service-quality logs tied to your user id are deleted from our servers immediately. The corresponding audio files in cloud storage are deleted on a best-effort basis as part of the same operation. See our Privacy Policy for full details.
We may suspend or terminate your account if you violate these Terms, if we are required to do so by law, or if we discontinue the service entirely. On termination by us, your right to use the service ceases immediately. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive.
10. Intellectual property
The TaleToaster name, logo, app, theme catalog, cover artwork, curated trivia, and underlying software are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or other intellectual property except as expressly permitted.
You retain ownership of the personal information you provide. You grant us a worldwide, non-exclusive, royalty-free license to use that information solely to operate the service.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) THE EQUIVALENT OF US$50 IN YOUR LOCAL CURRENCY.
13. Indemnification
You agree to indemnify, defend, and hold harmless TaleToaster, its operators, employees, contractors, and partners from any claim, loss, expense, or liability (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the service
- Your violation of these Terms
- Your violation of any rights of another party (including intellectual property rights)
- Information you submit to the service
14. App Store terms (Apple-specific)
If you downloaded TaleToaster from the Apple App Store, the following additional terms apply between you and Apple Inc.:
- These Terms are concluded between you and us, not with Apple. Apple is not responsible for the service or its content.
- Your license to use the app is non-transferable and limited to the Apple-branded products that you own or control, as permitted by the App Store Usage Rules.
- Apple has no obligation to provide maintenance or support for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- We — not Apple — are responsible for addressing any claims relating to the app or your use of it, including product-liability claims, claims that the app fails to conform to applicable laws, and claims arising under consumer protection or similar legislation.
- We — not Apple — are responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim relating to the app.
- You represent that you are not located in a country that is subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
15. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of India, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service is subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India. The Apple-specific terms in Section 14 survive any choice-of-law clause to the extent required by Apple's App Store policies.
16. Changes to these Terms
We may update these Terms from time to time. The "last updated" date at the top of this page indicates the version. If we make material changes, we will notify users via email and post a notice in the app at least 30 days before the changes take effect.
Your continued use of the service after the new Terms take effect constitutes acceptance of those Terms.
